Contested Divorce
A divorce will be contested if the parties do not agree to divorce or cannot reach an amicable agreement as to the following terms:
- grounds, or reasons, for divorce, however, since the New York state recognizes now no-fault divorce, if one party desires to divorce, she or he will obtain the divorce
- spousal maintenance, also known as alimony, reflecting the standard of living of the parties established during the marriage, and whether the party has a sufficient property or income to provide for his or her reasonable needs, and the ability of the payor spouse to make support payments
- child support
- child custody and visitation (based on the best interest of the child), or
- division of the marital property.
